A CHARTER ORDINANCE OF THE CITY OF EUDORA, KANSAS, PROVIDING THAT K.S.A. 2000 SUPP. 12-4112 AND ANY AMENDMENTS THERETO, SHALL NOT APPLY TO THE CITY OF EUDORA, KANSAS, EXEMPTING THE CITY OF EUDORA, KANSAS, THEREFROM, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; PROVIDING THE AUTHORIZATION FOR THE ASSESSMENT OF COURT COSTS IN CASES HEARD IN THE MUNICIPAL COURT OF THE CITY OF EUDORA, KANSAS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS:
SECTION I. The City of Eudora, Kansas, a Mayor/Council city of the third class, by the power invested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and exempts itself from, and makes inapplicable to it, K.S.A. 2000 Supp. 12 -4112, which is not uniformly applicable to all cities, and to provide substitute and additional provisions as hereinafter provided.
SECTION II. In lieu of K.S.A. 2000 Supp. 12-4112, the Governing Body of the City of Eudora, Kansas, hereby adopts the following provisions:
Each person found guilty of a violation of an ordinance of the City of Eudora shall be assessed costs for the administration of justice in the Municipal Court of the City of Eudora, Kansas, and such costs shall be determined by ordinance.
SECTION III. (Redacted)
SECTION IV. Charter Ordinances No. 3 and No. 4 of the City of Eudora, Kansas, are hereby repealed and of no further force and effect of it being the intent that this ordinance and its provisions be substituted in place thereof.
