A CHARTER ORDINANCE OF THE CITY OF EUDORA, KANSAS AMENDING CHARTER ORDINANCE NO. 10 (2007), PROVIDING THAT K.S.A. 15-204, AND ANY AMENDMENTS THERETO, SHALL NOT APPLY TO THE CITY OF EUDORA, KANSAS, EXEMPTING THE CITY OF EUDORA, KANSAS, THEREFROM, PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS THEREFOR, AND AMENDING SECTION 1-301 OF THE CODE OF THE CITY OF EUDORA, KANSAS, RELATING TO THE APPOINTMENT OF CITY OFFICERS, TERMS OF OFFICE, DUTIES AND COMPENSATION, AND REMOVAL FROM OFFICE.

WHEREAS, the Governing Body of the City of Eudora, Kansas adopted Charter Ordinance No.5 (2001) exempting the City from K.S.A. 15-204, and enacting Section 1-301 of the Code of the City of Eudora, Kansas, relating to the appointment of City officers, terms of office, duties and compensation and removal of office;

WHEREAS, the Governing Body of the City of Eudora, Kansas adopted Charter Ordinance No. 10 (2007), amending Charter Ordinance No. 5, exempting the City from K.S.A. 15-204, and amending Section 1-301 of the Code of the City of Eudora, Kansas; and

WHEREAS, the Governing Body believes it to be in the best interest of the City of Eudora, Kansas to amend Charter Ordinance No. 10 (2007), to exempt the City from K.S.A. 15-301, and to further amend Section 1-301 of the Code of the City of Eudora, Kansas as herein provided.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS:

SECTION I. The City of Eudora, Kansas, a Mayor/Council city of the third class, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it K.S.A. 15-204, and amendments thereto, which applies to this city but is part of an enactment which does not apply uniformly to all cities.

SECTION II. . The Governing Body of the City of Eudora, Kansas, hereby repeals Charter Ordinance No.5 (2001) and Charter Ordinance No. 10 (2007) and, in lieu of K.S.A. 15-204 and any amendments thereto, adopts the following provisions:

       OFFICERS; APPOINTMENT; REMOVAL. The mayor, with the consent of the council, may appoint, at the first regular meeting of the governing body in May of each year (subject to the below-described terms of office), the following city officers: a city treasurer, a municipal judge of the municipal court, a city attorney, and such other officers as deemed necessary. Such officers shall hold an initial term of office of not to exceed one year and until their successors have been appointed and qualified. Any officers who are reappointed shall hold their offices for a term of one year and until their successors are appointed and qualified. The duties and pay of the various officers shall be regulated by ordinance. Any officer may be removed by a majority vote of the total membership elected or appointed to the council and may be suspended at any time by the mayor.

SECTION III. Section 1-301 of the Code of the City of Eudora, Kansas, as amended by Charter Ordinance No.5 (2001) and Charter Ordinance No. 10 (2007), is hereby repealed and of no further force and effect, it being the intent of this charter ordinance that the provisions of Section II above be substituted in place thereof.
