A CHARTER ORDINANCE OF THE CITY OF EUDORA, KANSAS, PROVIDING THAT K.S.A. 15-204, AND ANY AMENDMENTS THERETO, SHALL NOT APPLY TO THE CITY OF EUDORA, KANSAS, EXEMPTING THE CITY OF EUDORA, KANSAS, THEREFROM, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS; AMENDING SECTION 1-301 OF THE CODE OF THE CITY OF EUDORA, KANSAS; RELATING TO THE APPOINTMENT OF CITY OFFICERS, TERMS OF OFFICE, DUTIES AND COMPENSATION, AND REMOVAL FROM OFFICE.

WHEREAS, the Governing Body of the City of Eudora, Kansas adopted Charter Ordinance No. 5 exempting the City from KS.A. 15-204, and enacting Section 1-301 of the Code of the City of Eudora, Kansas, relating to the appointment of City officers, terms of office, duties and compensation and removal of office; and

WHEREAS, the Governing Body believes it to be in the best interest of the City of Eudora, Kansas to amend Section 1-301 of the Code of the City of Eudora, Kansas as herein provided;

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EUDORA, KANSAS:

SECTION 1: The City of Eudora, Kansas, a Mayor/Council city of the second class, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it K.S.A. 15-204 and amendments thereto which applies to this city but is part of an enactment which does not apply uniformly to all cities.

SECTION 2: In lieu of K.S.A. 15-204 and any amendments thereto, the Governing Body of the City of Eudora, Kansas, hereby adopts the following provisions.

SECTION 3: The mayor, with the consent of the council, may appoint, at the first regular meeting of the governing body in May every other year, the following city officers: a city clerk, a city treasurer, a municipal judge of the municipal court, a city attorney, a city superintendent, a chief of police, fire chief, parks & recreation director and such other officers and employees as may be deemed necessary. Such officers shall hold an initial term of office of not to exceed one year and until their successors have been appointed and qualified. Any officers who are reappointed shall hold their offices for a term of two year and until their successors are appointed and qualified. Any officer may be removed by a majority vote of the council and may be suspended at any time by the mayor.

SECTION 4: Chapter 1, Article 3, Section 1-301 of the Code of the City of Eudora, Kansas (July 27, 2000), as amended by Chatter Ordinance No. 5, is hereby repealed and of no further force and effect, it being the intent of this charter ordinance that its provisions be substituted in place thereof.
