International Fire Code, 2021 Edition, including the following supplements and amendments to the Fire Code.

The Code, as adopted by the City, is hereby further modified or amended as follows:
(a) Definitions. Wherever “jurisdiction” or “name of jurisdiction” is used in the Code, that word or phrase shall mean the City of Eudora, Kansas.
(b) Referenced Codes. The codes and standards referenced in the Code shall be those that are listed in Chapter 80 of the Code. Such codes and standards shall be considered part of the requirements of the Code to the prescribed extent of each such reference. Required reviews and licensing requirements by the State of Kansas statutes (K.S.A.) and/or administrative regulations (K.A.R.) will also be included. Where differences occur between the provisions of the Code and the referenced standards or codes, the provisions of the most stringent shall apply.
(c) Storage of Flammable or Combustible Liquids or other Hazardous Materials; Aboveground or Underground Tanks; Chapter 50 and 57 of the Code; Other Requirements.
(1) New/Used Aboveground Storage Tanks, and all installation provisions and or modifications to existing tanks or piping or equipment must be approved by the Kansas State Fire Marshal’s Office and registered with Kansas Department of Health and Environment prior to installation of storage tanks. K.S.A. 31-133; K.A.R. 22.7.6; K.A.R. 22-7-7.
(2) New/Used Underground Storage Tanks, and all installation provisions and or modifications to existing tanks or piping or equipment must be approved by Kansas Department of Health and Environment -Storage Tank Section prior to installation. K.A.R. 28-43-9; K.A.R. 28-44-16; K.A.R. 28-44-17; K.A.R. 28-44-23.
(d) Storage of Liquefied Petroleum Gas; Chapter 61 of the Code; Other Requirements. New/Used ASTM storage tanks for Commercial Usage installation and piping must be approved and licensed through the Kansas State Fire Marshal’s Office prior to installation. K.S.A. 22-8-9; K.A.R. 22-8-5; K.S.A. 55-1812; K.S.A. 55-1810.
(e) Permits Required-Section 105.1.1 and 307.2 of the Code. The City of Eudora, Kansas Codes Administrator is authorized to issue operational and construction permits as provided by the Code. Permit fees shall be paid prior to issuance of the permit. Issued permits shall always be kept on the premises designated therein and shall be readily available for inspection by the fire code official.
(f) Open Burning – Add Section 307.2.2 A burning permit is required for the kindling or maintaining of an open fire or a fire on private grounds, and such activities shall be conducted in accordance with the City of Eudora, Kansas adopted ordinances.
(g) Violation Penalties-Section 112.4 of the Code. Persons who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate used under provision of this code, shall be guilty of a misdemeanor and shall be punished under the City of Eudora, Kansas fine ordinance, as amended. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
(h) Prohibited Areas-Section 310.2 of the Code. Smoking is regulated per City ordinance by the City of Eudora, Kansas.
(i) Fireworks—Add Section 5601.1.3 Exceptions: #5. Fireworks are regulated per City ordinance by the City of Eudora, Kansas.
(j) Fire Apparatus Access Roads; Appendix D of the Code. Must also comply with City of Eudora, Kansas, Subdivision Ordinance.
(k) Key Boxes-Section 502 and 506 of the Code. The approved type key box is the Knox Box Rapid Entry System, Phoenix, Arizona. Businesses are required to update key boxes as new technology becomes available.
(l) Daycares-Child/Adult; Group 1-4. All newly-established or existing daycares, registered or licensed or group, will be regulated by the Kansas Department of Health and Environment Division and the Kansas State Fire Marshal’s Office. K.S.A. 31-150; K.A.R. 22-18-3.
(m) Residential Sprinklers-Section 903.3.2 of the Code. The installation of automatic sprinkler systems for one- and two-family dwellings is an option of the builder and/or owner.
(n) Section 503.3 Marking, shall read:
503.3 Marking.
Where required by the fire code official, approved signs or other approved notices or markings that include the words NO PARKING—FIRE LANE shall be provided for fire apparatus access roads to identify such roads and prohibit the obstruction thereof. Striping, signs, and other markings shall always be maintained in a clean and legible condition and shall be replaced or repaired when necessary to provide adequate visibility.
503.3.1 Striping
Fire apparatus access roads shall be continuously marked by painted lines of red traffic paint six inches (6") in width to show the boundaries of the lane. The words "NO PARKING--FIRE LANE" shall appear in four-inch (4") white letters at twenty-five feet (25') intervals on the red border markings along both sides of the fire lanes. Where a curb is available, the striping shall be on the vertical and horizontal of the curb.
503.3.2. Signs
Signs, when approved by the fire code official, shall read "NO PARKING FIRE LANE" and shall be twelve inches (12") wide and eighteen inches (18") high. Signs shall be on a reflective white background with letters and borders in red, using not less than two inch (2") tall lettering. Signs shall be permanently affixed to a stationary post and the bottom of the sign shall be six feet, six inches (6' 6") above finished grade. Signs shall be spaced not more than fifty feet (50') apart along both sides. Signs may be installed on permanent buildings or walls or as approved by the Fire Chief.
503.3.3 Maintenance of markings
The person in possession of the premises on and into which a fire apparatus access roadway or fire lane is required shall be solely responsible for the maintenance of such roadways or fire lanes and all required signs. No owner, manager, or other person(s) in charge of premises served by a required fire apparatus access roadway or fire lane shall abandon, close, or alter the fire apparatus roadway or any part thereof without permission of the fire chief. The person(s) in possession of the premises shall be responsible for ensuring that fire apparatus roadways are always clear.
503.3.4 Grade
The gradient for a fire apparatus access road shall not exceed eight percent (8%).
Appendix D, Section D103 is hereby amended to read as follows:
D103.2 Grade. Fire apparatus access roads shall not exceed an eight percent (8%) grade increase or decrease in any 24 lineal feet of roadway.
503.3.5 Parking in fire lane
It shall be unlawful for any vehicle, equipment or device to park in or block a fire lane. Any owner of a vehicle, equipment or device found to have parked in or blocking a fire lane shall be cited or have vehicle, equipment, or device removed and impounded by police or the fire department.
(o) 505.1 Premises Identification
All address numerals shall be in contrasting color with their background. Where a building stands alone, it is required that the address numerals be placed on the building front in an approved location by the fire department official, visible from the nearest primary roadway, and that the minimum height of address numerals be six (6) inches when the building front is less than 150 feet from the nearest primary roadway, and increase two inches in height for every 50 feet more than 150 feet from the nearest primary roadway to a maximum required height of 12 inches. The stroke width shall be minimum one-half (1/2) inch for numerals up to eight (8) inches in height and increase in size to one (1) inch in width when the numeral height is required to be more than eight (8) inches. Where in a commercial building complex with multiple tenant spaces that share a main sign visible from the nearest primary roadway, each tenant space shall have its respective address number, including suite number, on their business front, that meets the requirements for stand-alone buildings as stated in this section, and the commercial building complex sign or sign post shall have address numerals on each side of the sign that faces a primary roadway, or on the post or pillar facing the roadway that holds the sign, of at least eight (8) inches in height and a minimum stroke width of one (1) inch for signs less than thirty-five (35) feet in height and ten (10) inches in height with a minimum stroke width of two (2) inches for signs more than thirty-five (35) feet in height. All suites within a commercial building complex that have a rear exit shall have their respective address numerals affixed to the rear exits, with the same requirements applicable to the business front. Where required by the fire code official, address numbers shall also be provided in additional approved locations to facilitate emergency response. Address numbers shall be maintained.

(p) 912.3 Fire hose threads
Fire hose threads used in connection with standpipe systems shall be approved and shall be compatible with fire department hose threads. The fire department connection, commonly referred to as an FDC, shall be a 5-inch STORZ connection.
(q) Appendix M of the 2021 International Fire Code is hereby amended to reads as follows:
APPENDIX M: RESIDENTIAL DAYCARE FACILITIES
M101 Purpose. The purpose of this Appendix is to provide a reasonable degree of safety to children and providers attending residential daycare facilities.
M102 Scope. The provisions of this Appendix shall apply to all newly established or existing licensed and group daycare facilities within the City of Eudora when other provisions and inspections are not provided for by the Kansas Office of the State Fire Marshal.
M103 Definitions.
Group Daycare - Care provided for no more than twelve (12) children less than 16 years of age.
Licensed Daycare - Care provided for no more than ten (10) children less than 16 years of age.
M104 Exits.
Escape Corridor. Every escape path, including all stairways, shall be clear of obstructions and all doors shall be in proper working condition.
Exit Doors. Every required exit door must always be capable of being easily opened from the inside when the facility is operating.
Exit Pathway. Passing by a Basement Stairway. If an exit pathway passes by a basement stairway, the stairway must be separated by a door or gate to prevent children from accidentally entering the basement.
M105 Doors.
Closet Doors. At all times, every closet door must be capable of being easily opened from the inside by children.
Bathroom Doors. Every bathroom door must always be capable of being unlocked from the outside. The unlocking key/device must be readily accessible to the staff.
M106 Basement and Second Floor Use.
Before May 1, 1998. Facilities which possess a certificate or daycare license dated before May 1, 1998 may use a basement or second floor for day-care only if there are at least two separate exits to the outside. One exit must be a door and one exit may be an approved escape window. Daycare providers must be able to demonstrate that everyone under their care can safely exit the house and go to a designated safe area within four (4) minutes. The code official may require daycare providers to demonstrate their ability to conduct such an exit drill.
On or After May 1, 1998. Facilities which possess a certificate or daycare license dated on or after May 1, 1998 may use a basement for day-care only if there are at least two exits to the outside. One exit must be a door leading directly to the outside. If the two exits in use are within ten (10) feet of each other, a third exit, which may be an approved exit window, will be required. Residential daycare is not allowed on the second floor of a residence. Bi-level houses must be inspected by the code official to determine if they comply with this provision prior to their use as a daycare facility.
M107 Portable Fire Extinguishers.
Type and Location. A fire extinguisher rated at 2A:10B:C: is required and must be placed or mounted so that the unit’s operating and mounting mechanisms are located no higher than 48 inches from the floor and no lower than 15 inches above the floor.
Maintenance. Fire extinguishers provided for the day-care must be inspected and/or serviced and tagged within the previous 12 months by a person or business licensed by the Kansas State Fire Marshal. If the fire extinguisher is purchased new, a purchase receipt must be retained that shows the date of purchase. Such a new fire extinguisher does not need to be inspected within the first 12 months after the date shown on the purchase receipt.
M108 Smoke Detectors.
Smoke Detector Installation. Smoke detectors shall be installed on every level of the residence according to the manufacturer’s instructions. Smoke detectors shall be in the pathways serving sleeping and use areas and in each sleeping room used for children.
Smoke Detector Maintenance. Smoke detectors shall be tested monthly. The batteries in battery-powered smoke detectors shall be changed every six months and records of the tests and battery changes required in this section shall be kept on file for review upon request of the code official. The batteries in standard battery-powered smoke detectors shall be changed every six months and the battery replacement documented with monthly detector tests. Standard battery-powered smoke detectors shall be replaced within ten years of the date of manufacture with 10-year lithium or 110-volt interconnected smoke detectors.
M109 Heating Devices.
Venting. All natural gas, kerosene, wood, propane heaters, and other open flame heating devices shall be properly vented to the outside of the residence.
Protective Barriers. All heating devices shall be shielded by a noncombustible barrier that prevents accidental contact with the devices.
Combustible Storage. No combustible storage is allowed within 36 inches of the furnace or hot water heater or other open flame device. All heating devices shall be kept clean and dust free.
M110 Emergency Procedures.
Exit Drills. Exit drill procedures shall be posted and exit drills shall be conducted monthly. Accurate written records of the exit drills conducted in the previous twelve months shall be kept and posted in plain view at the daycare.
Tornado Procedures. Written emergency procedures for tornadoes shall be posted and shall be practiced monthly. Accurate written records of the emergency tornado procedures practice conducted in the previous twelve months shall be kept and posted in plain view at the daycare.
M111 General Fire Safety.
Electrical Outlets. All unused electrical outlets in licensed areas shall have child-resistant protective covers in place.
Flashlights. A working flashlight shall be available for each staff member in the daycare.
