A request is made to the vehicle department of the State of Kansas not to issue operator’s licenses to minors under the age of 16 except upon a showing of necessity and in accordance with the procedure established by K.S.A. 8-237. The city clerk is hereby directed to forward a copy of this section to the vehicle department of the State of Kansas.

When signs are in place giving notice thereof, parking shall be prohibited between the hours of 7:30 a.m. and 4:30 p.m., Monday through Friday in the following locations:

(a)   On both sides of Elm Street from the intersection line of Tenth Street south to the intersection of Fifteenth Street.

(b)   On the west side of Elm Street from the intersection line of Fifteenth Street south to the intersection of Sixteenth Street.

When signs are in place giving notice thereof, parking shall be prohibited at all times in the following places:

(a)   On both sides of Winchester Road from the south edge of Tenth Street to the north edge of the highway K-10 overpass.

(b)   On the north side of Thirteenth Street from the east edge of Tallgrass and the west edge of Bluestem Streets.

(c)   On the west one-half of the cul-de-sac known as Ash Court to the north edge of Fourteenth Street on the south.

(d)   East side of Elm Street between Fifteenth Street and Eighteenth Street (the 1600 and 1700 blocks of Elm Street).

(a)   The maximum speed shall not exceed 25 miles per hour unless otherwise posted within the City of Eudora, Kansas.

(a)   No person shall operate or halt any vehicle in such a manner as to indicate a careless or heedless disregard for the rights or the safety of others, or in such a manner as to endanger or be likely to endanger, any person or property.

(b)   Any person found, upon conviction, to have violated any provision of this section shall be subject to the general penalties as provided in the Standard Traffic Ordinance, as incorporated by reference by section 14-101 of this code.

Parking is hereby prohibited at the following locations:

(a)   Twelfth Street, both sides, from the intersection line of Cherry Street west to the city limits.

(b)   Cedar Street, both sides, from the intersection line of Twelfth Street.

(c)   Eleventh Street, both sides, from the intersection line of Cedar Street to the intersection line of Cherry Street.

(d)   Fourteenth Street, both sides, from the intersection line of Church Street east to the intersection line of Tall Grass Drive.

(a)   A person commits an offense if he or she parks or leaves a vehicle unattended or attended for a period of time longer than designated or at a time when parking is prohibited on private property used by the public for purposes of vehicular traffic by permission of the owner. The owner or operator of such property shall have the authority, subject to approval of the governing body of the city, to designate by appropriate signs and markings the parking time limit, which shall not be less than one hour, the areas in which parking is permitted, and times when the parking of vehicles is prohibited.

(b)   The owner or operator of such property used by the public is authorized to erect suitable signs upon approval of the governing body of the city, which shall be placed on such property advising the public of the limits and conditions of the parking regulations. A sign shall be erected with the following words, legibly painted thereon:

“Traffic Regulations of the City of Eudora, Kansas, enforced on this property. No parking from _____ to _____ (or as posted).”

(c)   The owner or operator of such property used by the public shall mark off by painting on the parking lot the most suitable manner in which cars may be parked. A person who parks a vehicle thereon shall park the vehicle within the limit line so marked.

(d)   Any person, firm or corporation violating the provisions of this section shall be deemed guilty of a violation of this code and upon conviction thereof shall be punished by a fine in an amount set by resolution of the governing body from time to time.

It shall be unlawful for any driver of a motor vehicle to cross the oncoming traffic lane for the purposes of parking the vehicle on the right-hand side of the oncoming traffic lane.

(a)   The intersection of 14th Street and Tallgrass Street in the City of Eudora, Kansas is hereby designated and established as an all-way stop intersection requiring the driver of any vehicle intending to enter the intersection from any direction to come to a complete stop, prior to entering the intersection.

(b)   The intersection of 12th and Elm Streets in the City of Eudora, Kansas, is hereby designated and established as an all-way stop intersection requiring the driver of any vehicle intending to enter such intersection from any direction to stop the movement of such vehicle before entering the intersection.

The intersection of 14th Street and Chestnut Lane in the City of Eudora, Kansas is hereby designated and established as a three-way stop intersection requiring the driver of any vehicle intending to enter the intersection from the west, east or north to come to a complete stop, prior to entering the intersection.

The intersection of 14th & Acorn Streets in the City of Eudora, Kansas, is hereby designated as a two-way stop intersection, requiring the driver of any vehicle intending to enter such intersection from the east or west on 14th Street to stop the movement of such vehicle before entering the intersection in the manner provided by K.S.A. 8-15-27, as amended.

(a)   There is hereby established the School Zone designation in the City of Eudora, Kansas, as provided by K.S.A. 8-1560(a) (4) and K.S.A. 8-2002(a) (10 and 11).

(b)   No person shall drive a vehicle on any street of this city designated by signage as a School Zone at a speed in excess of 20 miles per hour when signs, beacons, or both, are in place giving notice of such speed limit.

(c)   The twenty miles per hour maximum speed limit shall apply when signs reading: 7:15 a.m. to 8:30 a.m., 11:00 a.m. to 12:00 p.m. and 3:00 p.m. to 4:00 p.m. on SCHOOL DAYS WHEN CHILDREN ARE PRESENT, or similar wording, have been installed for a School Zone.

(d)   As an alternative to the requirements set forth in subsection (c), the twenty mile per hour maximum speed limit shall apply when appropriate signs have been installed stating the speed limit applies when the beacon is flashing.

The city hereby approves of the recommended weight limits for the 9th Street bridge, located between Acorn and Oak streets, and the installation of an R12-5 Regulatory Sign proscribing the weight limits for such bridge, all being within the corporate limits of the City of Eudora, Kansas, such that the limits shall be nine (9) tons, thirteen (13) tons, and twenty-one (21) tons, as they correspond to vehicles classified by the number of axles. The officers of the city are hereby authorized and directed to take such further action as they deem reasonably necessary or appropriate to carry out the purposes of this section.

(a)   It shall be unlawful for any person to park, stop, or stand a vehicle, motor vehicle, or motorized bicycle on the streets, alleys, public areas, park grounds, public or private parking lots or other publicly accessible areas of the city if such vehicle, motor vehicle, or motorized bicycle does not have a license plate or displays an unlawful state license plate.

(b)   The display of an unlawful state license plate shall be defined to be any one or more of the following:

(1)   Any license plate not lawfully issued to such vehicle;

(2)   Any expired license plate;

(3)   Any suspended, revoked or canceled license plate;

(4)   Any stolen license plate;

(5)   Any altered, defaced or fictitious license plate;

(6)   Any license plate without the current registration attached to it as required by state law;

(7)   Any license plate that is not securely attached to the rear of the vehicle with the correct side up and in a manner that makes it clearly visible and legible.

(b)   Nothing in this section shall be interpreted as conflicting with section 198 of the Standard Traffic Ordinance, as adopted in 14-101 of the City Code.

(c)   Violation of this section shall be considered a parking infraction, and upon conviction, the violator shall receive a fine as set by resolution of the governing body from time to time.

(a)   No person shall park a vehicle off the street in the front or side yard setback area, which shall be defined as the area between the public right-of-way and the rear line of a building or any projection thereof, unless  parking on approved driveway surfaces required by the city code. The city commission and/or the city manager may determine that the provisions of this section are not to be enforced for a specified location or locations for a period no to exceed forty-eight hours.

(b)   Violation of this section shall be punishable by a fine, in an amount set by resolution of the governing body from time to time, for each offense. Each day’s violations shall constitute a separate offense.

(a)   No motorized self-propelled camper non-motorized trailer, or boat or canoe, when on a trailer, shall be parked on a public street for a period of time exceeding 48 hours, and when so parked shall be located no nearer to an intersection than 100 feet, from the intersecting curb lines of the two streets nor located so as to obscure any driver’s view of approaching traffic. No non-motorized travel trailer or boat or canoe, when on a trailer, shall be left unattached when parked on a public street.

(b)   Violation of this section shall be punishable by a fine, in an amount set by resolution of the governing body from time to time, for each offense. Each day’s violations shall constitute a separate offense.

Passenger Vehicles that are parked on a residential street, alley, or right-of-way must move every 48 hours. In addition, it shall be unlawful to park a Vehicle that is not a Passenger Vehicle, Car, Passenger Van, Pickup Truck or Motorcycle on a residential street, alley, or right-of-way for more than twenty-four (24) hours within a three (3) day time period for loading and unloading purposes.

No person or persons operating or occupying a motor vehicle on any street, highway, alley, parking lot, or driveway shall operate or permit the operation of any sound amplification system from within or upon the vehicle so that the sound is audible at a distance of fifty (50) feet or more from the vehicle. Nothing in this ordinance shall require the witnessing law enforcement officer to physically measure the distance from the officer to the allegedly offending vehicle operator and vehicle prior to the issuance of a citation.

(a)   It shall be unlawful for any person, firm, corporation, or other entity to operate a truck, trailer, or semi-trailer with a registered gross vehicle weight in excess of 20,000 pounds (lbs.) on any street within the corporate limits of the City of Eudora, Kansas, other than the following designated truck routes:

(1)   Main Street from the 6th Street to 10th Street;

(2)   10th Street;

(3)   Church Street from 10th Street to 28th Street.

(b)   Exceptions. The provisions of subsection (a) above shall not apply to the following vehicles when used for the following purposes, provided that operators of such vehicles shall nevertheless use the most direct route possible between origin and destination, using required truck routes whenever possible:

(1)   Emergency Vehicles:  The operation of any emergency vehicle.

(2)   Maintenance and Construction Trucks:  The operation of any vehicle owned or operated a contractor or material man that is engaged in any repair or construction work performed on property located within the city.

(3)   Municipal Vehicles:  The operation of any vehicle by or on behalf of the city, including its solid waste contractor.

(4)   Delivery Trucks:  The operation of any truck carrying goods, merchandise, or other articles to or from any location in the city; provided, that any truck so engaged enters the city at a cross street nearest to that location in the direction in which that vehicle is moving and upon delivering or receiving the goods, merchandise or other articles, the truck proceeds upon the street or streets providing the most direct access to the next destination of that truck.
