The International Fuel Gas Code, 2021 Edition, as published by the International Code Council, be and is hereby adopted as the Fuel Gas Code of the City of Eudora, Kansas, regulating and governing fuel gas systems and gas-fired appliances in the incorporated areas of the City of Eudora, Kansas as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions, and terms of said Fuel Gas Code are hereby to, adopted and made a part hereof, as if fully set out herein, with the additions, inspections, deletions.

Not less than one copy of the International Fuel Gas Code, 2021 Edition, marked and stamped in the manner provided by K.S.A. 12-3304, shall be filed with the City Clerk and shall be open to inspection and available to the public at reasonable business hours. Subsequent references to the "Fuel Gas Code" shall mean the International Fuel Gas Code, 2021 Edition, as adopted and amended herein.

The International Fuel Gas Code, 2021 Edition, is amended or supplemented as provided below.

4-902.1. Chapter 1 of the Fuel Gas Code is deleted and replaced with the provisions of Article 1 of this Chapter 4.

4-902.2. Section 303.3. Prohibited Locations. Appliances shall not be located in sleeping rooms, bathrooms, toilet rooms, hot tub rooms, storage closets, or surgical rooms or in a space that opens only into such rooms or spaces, except where the installation complies with the following:

1.     A single wall-mounted unvented room heater is installed in a bathroom, and such unvented room heater is equipped as specified in Section 621.6 and has an input rating not greater than 6,000 Btu/h (1.76 kW) and a carbon monoxide detector, meeting the requirements of Section R315, is installed in the same room as the appliance. The bathroom shall meet the required volume criteria of Section 304.5

2.     A single wall-mounted unvented room heater is installed in a bedroom, and such unvented room heater is equipped as specified in Section 621.6 and has an input rating not greater than 10000Btu/h (2.93 kW) and a carbon monoxide detector, meeting the requirements of Section R315, is installed in the same room as the appliance. The bedroom shall meet the required volume criteria of Section 304.5

4-902.3. Section 406.4.1. Fuel Gas Test Pressure. Section 406.4.1. is amended so that the minimum test pressure is increased from 3 psig (20 kPa gauge) to 10 psig (69kPa gauge).

If any section, subsection, sentence, clause, or phrase in this Article or in the Fuel Gas Code is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions hereof. The Building Official declares that it would have passed this code and each section, subsection, clause, or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid.

Nothing herein or in the Fuel Gas Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing under any act or resolution repealed in connection with the adoption of the Fuel Gas Code; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this legislation.
